User Agreement

You agree to these terms when you use our games or any of our services.

Welcome to GamestBase. This Agreement governs your access and use of products, content and services offered by GamestBase and its subsidiaries ("GamestBase"), such as game software and related updates, upgrades and features, and all online and mobile services, platforms, websites, and live events hosted by or associated with GamestBase and may provide in the future, referred to "Products and Services").

BY USING GamestBase SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE GamestBase SERVICES. FOR RESIDENTS OF CERTAIN COUNTRIES, YOU AGREE TO THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER DESCRIBED IN SECTION 15 TO RESOLVE ANY DISPUTES WITH GamestBase.

GamestBase especially reminds users to carefully read all the terms of this agreement, especially the terms that exempt or limit the game liability of GamestBase (such terms usually contain words such as "not responsible", "not guaranteed"), the terms that limit the rights of users (such terms usually contain words such as "shall not", "should not", "not allowed", "prohibited"), legal Application and Dispute Resolution Provisions. These terms shall apply to the fullest extent permitted by law, and such terms are usually highlighted in red.

Content and Entitlements

• GamestBase products and services are provided by GamestBase according to the actual situation, such as online games, mobile software, forums (BBS), chat rooms, emails, etc. GamestBase reserves the right to change, interrupt or terminate some or all products and services at any time.

• GamestBase may charge some users certain amount of fee to providing products and services. In such cases, there will be a clear indication on the relevant page. If users do not agree to pay, they can choose not to accept the corresponding products and services.

• GamestBase provides products and services to users through equipment accessing Internet, other equipments related to the products and services (such as computers, cell phones, modems and other devices related to Internet access) and the required fees (such as telephone and Internet access fees paid for Internet access) shall be borne by the users themselves.

• Users shall use the licensed software to receive the products and services, and the cost of the software shall be borne by the users themselves.

• GamestBase provides games, features and content through a series of entitlements. Some entitlements are unlocked using virtual currency that has no value outside of our games.

The GamestBase Services include Content and Entitlements. Content is the software, technology, text, forum posts, chat posts, profiles, widgets, messages, links, emails, music, sound, graphics, pictures, video, code, and all audio visual or other material appearing on or coming from GamestBase Services, as well as the design and appearance of our websites. Content also includes user-generated Content ("UGC"). UGC includes GamestBase Account personas, forum posts, profile content and other Content contributed by users to GamestBase Services. All Content is either owned by GamestBase or its licensors, or is licensed to GamestBase and its licensors pursuant to Section 5 below.

Entitlements are rights that GamestBase licenses to you to access or use the online or off-line elements of GamestBase Services. Examples of Entitlements include access to digital or unlockable Content; additional or enhanced functionality (including multiplayer services); subscriptions; virtual assets; unlock keys or codes, serial codes or online authentication; in-game accomplishments; and virtual points, coins, or currencies.

We refer to these virtual points, coins or currencies as "GamestBase Virtual Currency". When you obtain GamestBase Virtual Currency from us or our authorized partners, you receive a personal, limited, non-assignable, non-exclusive, revocable license to access and select the Entitlements that GamestBase expressly makes available to you.

GamestBase Virtual Currency has no monetary value and has no value outside of our products and services. GamestBase Virtual Currency cannot be sold, traded, transferred, or exchanged for cash; it only may be redeemed for Entitlements available for the GamestBase Service. GamestBase Virtual Currency is non-refundable, and you are not entitled to a refund for any unused GamestBase Virtual Currency. Once you redeem GamestBase Virtual Currency for an Entitlement, that Entitlement is not returnable, exchangeable, or refundable. If you live in Japan, you agree to use any GamestBase Virtual Currency within 180 days from the date of purchase.

You will provide at your own expense the equipment, Internet connection and charges required to access and use GamestBase Services.

Availability of Services and Updates

ⓘ Our games and services may not always be available or operate on all devices. We also may make updates or changes to our games and services, which might impact your use or game progress.

We do not guarantee that any GamestBase Service, Content or Entitlement will be available at all times, in all locations, or at any given time or that we will continue to offer a particular GamestBase Service, Content or Entitlements for any particular length of time. GamestBase does not guarantee that GamestBase Services can be accessed on all devices, by means of a specific Internet or connection provider, or in all geographic locations.

From time to time, GamestBase may update, change or modify an GamestBase Service, Content or Entitlements, without notice to you. These updates and modifications may be required in order to continue to use GamestBase Services.

GamestBase may need to update, or reset certain parameters to balance game play and usage of GamestBase Services. These updates or "resets" may cause you setbacks within the relevant game world and may affect characters, games, groups or other Entitlements under your control.

GamestBase may also take actions on your GamestBase Account and Entitlements without notice to you to protect you or GamestBase, such as preventing unauthorized access, resetting GamestBase Account passwords, suspending GamestBase Account access, deleting data or removing GamestBase Accounts from GamestBase Services. Your availability to GamestBase Services may also be affected in response to actual or suspected Rules of Conduct violations, as further described in Section 6.

5. Your UGC

ⓘ You allow GamestBase and our players to use anything you upload or create (UGC) for free within our games and services. You are responsible for your UGC, it must be your own content or content you’re allowed to use.

You are responsible for your UGC. You may not upload UGC that infringes a third party's intellectual property rights or that violates the law, this Agreement or a third party's right of privacy or right of publicity.

GamestBase may, in its sole discretion, remove, edit or disable UGC for any reason, including if GamestBase reasonably determines that UGC violates this Agreement. GamestBase does not assume any responsibility or liability for UGC, for removing it, or not removing it or other Content. GamestBase does not pre-screen all UGC and does not endorse or approve any UGC available on GamestBase Services.

When you contribute UGC, you grant to GamestBase, its licensors and licensees a non-exclusive, perpetual, transferable, worldwide, sublicensable license to use, host, store, reproduce, modify, create derivative works, publicly perform, publicly display or otherwise transmit and communicate the UGC, or any portion of it, in any manner or form and in any medium or forum, whether now known or later devised, without notice, payment or attribution of any kind to you or any third party. You also grant to all other users who can access and use your UGC on an GamestBase Service the right to use, copy, modify, display, perform, create derivative works from, and otherwise communicate and distribute your UGC on or through the relevant GamestBase Service without further notice, attribution or compensation to you.

The password corresponding to the account can be modified through GamestBase official customer service or by themself.

The user is fully responsible for the custody of the GamestBase account and password, and all actions taken with the account and password. GamestBase prohibits users from selling, transferring, lending, or sharing GamestBase accounts or passwords to others. GamestBase is not responsible for any illegal use of the user's GamestBase account or password due to the user's custodial negligence or any third party's actions, and any consequences arising therefrom.

If users find that their GamestBase accounts or passwords are illegally used by others or have abnormal use, should promptly notify GamestBase in accordance with the processing methods announced by GamestBase from time to time, and have the right to request GamestBase to suspend the login and use of the account. GamestBase has the right to decide whether to suspend the login and use of the user's account based on the results of the user's identity verification.

If the user chooses to quickly log into the game without registering a user account through "Quick Game", "Guest" or other similar convenient modes (hereinafter referred to as "Guest Mode"), please bind a email in time after logging in; if the user does not bind a user account, once the user chooses to uninstall or reinstall GamestBase' products/game, or the user's mobile device or computer is damaged, the products or game app cannot start normally, the user's entire game data, game records and other content in Guest Mode will not be able to be checked or restored.

Account Registration Information

• Provide registration information

• （1）When applying for a GamestBase account (or adding information after registration), users shall provide up-to-date, detailed, true and accurate registration information. The aforementioned personal registration information includes: the user's GamestBase account name, password and all information entered when registering for a GamestBase account (or when supplementing or updating account information). Users hereby promise: Users should register as users of GamestBase with their real identity in accordance with the provisions of relevant laws and regulations and the relevant guidelines provided by GamestBase. Ensure that the personal identity data information provided is true, complete and valid, and bear the corresponding legal responsibility for the information provided in accordance with the legal provisions and the agreement of the necessary terms and conditions, and some of the functions of the GamestBase account may be restricted for users who do not have real name authentication. GamestBase shall provide users with the necessary assistance and support such as proof of account registrant and original registration information, and provide relevant evidence and information materials to relevant administrative organs and judicial organs as needed.

• All personal registration information provided by the user may be used by GamestBase as the sole basis for determining the relevance of the GamestBase account and for identifying the user. The user agrees to provide proof of such information at any time upon the request of GamestBase in order for GamestBase to verify the identity of the user.

• If the information provided by the user is inaccurate, untrue, illegal and invalid, or has been changed and not updated in time, or there is any suspicion of misleading, GamestBase has the right to suspend or terminate the user's use of any services of GamestBase until the user provides information that meets the requirements. GamestBase shall notify the user of the suspension measures and inform the user of the suspension period, which shall be reasonable, and GamestBase shall promptly resume the service to the user upon the expiration of the suspension period.

• （4）GamestBase has the right to examine whether the identity information provided by the user's registration is true and valid, and shall actively take reasonable measures such as technology and management to protect the security and validity of the user's account; the user has the obligation to properly keep account and password, and use account and password correctly and safely. If any party fails to fulfill the above obligations and causes damage the rights of the other party due to the loss of the account password or theft of the account, the party shall bear the legal responsibility arising therefrom.

• Modify registration information

• User has right to update or modify the information provided by the user when applying for registration at any time by logging into the official website of GamestBase, on the "User Center" page, or through other means published by GamestBase. GamestBase shall provide this service for them in a timely and effective manner.

• Users agree that all information, data and records related to their GamestBase accounts (including but not limited to login records, post-login behavior records, point card information, etc.) shall be subject to the data recorded by the GamestBase system.

Rules of Conduct

We want you to have a good time playing our games. So we expect you, like all players, to respect GamestBase, our employees and representatives as well as your fellow players. This means, for example, obey the law, don’t cheat, don’t be offensive, don’t hack our software, don’t spam or bot, don’t lie to GamestBase or our players. Those are the highlights. Read the full list of what not to do in the Rules of Conduct.

When you access or use an GamestBase Service, you agree that you will not:

• Violate any law, rule or regulation.

• Interfere with or disrupt any GamestBase Service or any server or network used to support or provide an GamestBase Service, including any hacking or cracking into an GamestBase Service.

• Use any software or program that damages, interferes with or disrupts an GamestBase Service or another's computer or property, such as denial of service attacks, spamming, hacking, or uploading computer viruses, worms, Trojan horses, cancelbots, spyware, corrupted files and time bombs.

• Interfere with or disrupt another player's use of an GamestBase Service. This includes disrupting the normal flow of game play, chat or dialogue within an GamestBase Service by, for example, using vulgar or harassing language, being abusive, excessive shouting (all caps), spamming, flooding or hitting the return key repeatedly.

• Harass, threaten, bully, embarrass, spam or do anything else to another player or any GamestBase employee or representative that is unwanted, such as repeatedly sending unwanted messages or making personal attacks or statements about race, sexual orientation, religion, heritage, etc. Hate speech is not tolerated. We won't tolerate any unwanted conduct against any GamestBase employee and representative because of their affiliation with GamestBase in GamestBase Services or anywhere else.

• Contribute UGC or organize or participate in any activity, group or guild that is inappropriate, abusive, harassing, profane, threatening, hateful, offensive, vulgar, obscene, sexually explicit, defamatory, infringing, invades another's privacy, or is otherwise reasonably objectionable.

• Publish, post, upload or distribute UGC or content that is illegal or that you don't have permission to freely distribute.

• Publish, post, upload or distribute any content, such as a topic, name, screen name, avatar, persona, or other material or information, that GamestBase (acting reasonably and objectively) determines is inappropriate, abusive, hateful, harassing, profane, defamatory, threatening, obscene, sexually explicit, infringing, privacy-invasive, vulgar, offensive, indecent or unlawful.

• Post a message for any purpose other than personal communication. Prohibited messages include advertising, spam, chain letters, pyramid schemes and other types of solicitation or commercial activities.

• Impersonate another person or falsely imply that you are an GamestBase employee or representative.

• Improperly use in-game support or complaint buttons or make false reports to GamestBase staff.

• Attempt to obtain, or phish for, a password, account information, or other private information from anyone else on GamestBase Services.

• Make use of any payment methods or refund systems to access, purchase or refund GamestBase Services for fraudulent purposes, or without permission of the authorized owner, or otherwise concerning a criminal offence or other unlawful activity.

• Use any robot, spider or other automated device or process to access GamestBase Services for any purpose such as scraping data, abuse GamestBase Services, account creation, or copying material.

• Modify any file or any other part of the GamestBase Service that GamestBase does not specifically authorize you to modify.

• Use or distribute unauthorized software programs or tools (such as "auto", "macro", hack or cheat software), or use exploits, bugs or problems in an GamestBase Service to gain unfair advantage.

• Engage or assist in cheating or other anticompetitive behavior (such as boosting, collusion, and match or matchmaking manipulation).

• Use or distribute counterfeit software or GamestBase Content, including GamestBase Virtual Currency.

• Attempt to use an GamestBase Service on or through any service that is not controlled or authorized by GamestBase, or otherwise intentionally obfuscate your network connection or location or other metadata to gain access to an GamestBase Service, make purchases, or otherwise access an GamestBase Service.

• Sell, buy, share, trade or otherwise transfer or offer to transfer your GamestBase Account, any personal access to GamestBase Services, or any GamestBase Content associated with your GamestBase Account, including GamestBase Virtual Currency and other Entitlements, either within an GamestBase Service or on a third-party website, or in connection with any out-of-game transaction, unless expressly authorized by GamestBase.

• Use an GamestBase Service in a country in which GamestBase is prohibited from offering such services under applicable export control laws.

• If an GamestBase Service requires you to create a "username" or a "persona" to represent yourself in-game and online, you should not use your real name and may not use a username or persona that is used by someone else or that GamestBase determines is vulgar or offensive or violates someone else's rights.

• Engage in any other activity that significantly disturbs the peaceful, fair and respectful gaming environment of an GamestBase Service.

• Use information about users publicly available in any GamestBase Service (e.g. on a leaderboard) for any purpose unrelated to the Service, including to attempt to identify such users in the real world.

• Promote, encourage or take part in any prohibited activity described above.

To enforce these rules, we may monitor your activity and remove any UGC. If you don’t follow these rules, we may warn you, suspend you, ban you permanently or place other restrictions on your GamestBase Account, games, or related services.

If you or someone using your GamestBase Account violates these rules and fails to remedy this violation after a warning, GamestBase may take action against you, including revoking access to certain or all GamestBase Services, Content or Entitlements, or terminating your GamestBase Account as described in Section 8. In case of severe violations, GamestBase may take these actions without issuing a prior warning. Some examples of severe violations include, but are not limited to: promoting, encouraging or engaging in hacking, selling GamestBase accounts or entitlements (including virtual currencies and items) without GamestBase’s permission, extreme harassment, or threatening illegal activities. When practical, GamestBase will notify you of the action it will take in response to violations of these rules or breach of this Agreement.

Specific GamestBase Services may post additional rules that apply to your conduct on those services.

GamestBase may, in its discretion, monitor or record online activity or Content on GamestBase Services and may remove any Content from any GamestBase Service at its discretion. Remember that your communications and your UGC in an GamestBase Service are public and will be seen by others.

Technical and Content Protection Measures

We use specific security software to combat piracy and cheating, and tampering with it can result in losing access to our games.

GamestBase utilizes technical or content protection measures, developed by GamestBase or third-party partners, for GamestBase Services in order to prevent piracy and the unauthorized copying or use of GamestBase Games. Attempting to circumvent, disable or tamper with these measures shall terminate this license.

Monitoring and Anti-Cheat Measures

ⓘ GamestBase installs software to detect cheating or hacking. These programs send data on your computer to GamestBase.

GamestBase utilizes technologies to detect and prevent cheating in the use of GamestBase Services, and in particular, GamestBase Games. These technologies may be developed by GamestBase or a third party.

When you launch an online-capable game, these technologies may activate using kernel, admin or user privileges, and monitor your gameplay and device’s RAM, processes, communications, and file storage for the purposes of detecting violations of, and enforcing, the Code of Conduct in Section 6, including the use of Unauthorized Third-Party Programs. An Unauthorized Third-Party Program is a third-party program or file (such as a "add-on", "mod", "hack", "trainer", or "cheat") that GamestBase believes (i) enables or facilitates cheating of any type; (ii) allows users to modify or hack the game interface, environment, and/or experience in any way not expressly authorized by GamestBase; or (iii) intercepts, "mines", or otherwise collects information from or through the game.

GamestBase may collect relevant information needed for our investigation and enforcement purposes such as your account information, details related to an Unauthorized Third-Party Program, any GamestBase PC Game files that were modified, and times cheating was detected. We also may terminate your License and your GamestBase Account if we determine you have been cheating.

When you exit an online-capable game, these anti-cheat technologies will be deactivated.

Termination and Other Sanctions

If you break this agreement or the law, GamestBase may suspend or terminate your use of our games and services, without refunds.

If we decide to shut down a game or a service, we will tell you at least 30 days in advance.

This Agreement is effective until terminated by you or GamestBase. GamestBase may terminate your access and use of any GamestBase Services or your Game Account if GamestBase determines that you have violated this Agreement or that there has been otherwise unlawful, improper or fraudulent use of GamestBase Services on your GamestBase Account. When practical, GamestBase will notify you of the termination. You may lose your username and persona as a result of an GamestBase Account termination. If you have more than one GamestBase Account, depending on the type of violation or misuse, GamestBase may terminate all of your GamestBase Accounts and all related Entitlements. If your GamestBase Account is terminated, you will not have access to your GamestBase Account or Entitlements and may be barred from accessing or using any GamestBase Service again. Upon termination, your license under this Agreement also shall terminate.

Instead of termination and prior to any termination, GamestBase may issue you a warning, suspend or alter your access to a particular GamestBase Service or your GamestBase Account, remove or revoke Entitlements at an GamestBase Account or device level, remove or delete any Content which is in violation with this Agreement, or ban your device or machine from accessing specific GamestBase Services. If GamestBase takes any action described in this Section, you will not be entitled to a refund (subject to any statutory refund rights) and no Entitlements will be credited to you or converted to cash or other forms of reimbursement.

GamestBase may terminate any GamestBase Service at any time by giving at least thirty days' notice either via email (if available), within the affected GamestBase Service. After online service termination, no software updates will be applied to our games and we can't guarantee our games will continue to function on newer or updated operating systems or be available for download via application distribution services such as the iOS App Store and the Google Play Store. Any games available via such application distribution services after online service termination may be removed without further notice to you.

If you terminate this agreement, you agree to cease all use of GamestBase Services.

Use of Data

GamestBase collects various information when you play our games (even offline) to operate our business, improve our products and services, enforce our rules and communicate with you.

When you use an GamestBase Service, GamestBase may collect and store data from your computer or device, including information about your computer or device, hardware, installed software, and operating system (such as IP Address and device ID), information about your GamestBase Service usage, gameplay and usage statistics, system interactions and peripheral hardware. If you play an GamestBase Service offline, this data will be stored on your device and transmitted to GamestBase when your device connects to the Internet. GamestBase uses this information to operate its business, improve its products and services, provide services to and communicate with you (including for marketing purposes), provide software updates, dynamically serve content and software support, enforce this Agreement, and trouble-shoot bugs or otherwise enhance your experience. If you participate in online services, GamestBase also may collect, use, store, transmit and publicly display statistical data regarding game play (including scores, rankings and accomplishments), or identify content that is created and shared by you with other players.

You can manage certain data collection preferences in the Settings tab of the GamestBase PC Game client.

Other Software, Utilities and Tools

If we update our games, you may need new software to keep playing our games.

GamestBase Services may require or allow you to download software, software updates or patches, or other utilities and tools from GamestBase or its licensors onto your computer, entertainment system or device. These technologies may be different across platforms, and the performance of GamestBase Services may vary depending on your computer and other equipment. You understand that certain updates to these technologies may be required in order to continue use of an GamestBase Services. Some of these updates may contain locked features or content that require you to pay an additional fee to access them. You consent to GamestBase automatically installing any available updates for GamestBase Services. Failure to install available updates may render GamestBase Services, including GamestBase PC Games, unplayable.

Third Parties

You are responsible for your use of game servers and services not owned by GamestBase.

Some GamestBase Services may give you the option of playing on servers not owned or controlled by GamestBase. GamestBase does not control those services and is not responsible for your use of the GamestBase Service on or through them. These third-party services may subject you to additional or different terms and restrictions.

GamestBase Services may include hyperlinks to third-party websites. Those sites may collect data or solicit personal information from you. GamestBase does not control those sites and is not responsible for their content or for their collection, use or disclosure of personal information.

Warranties; Limitation of Liability

GamestBase does not make any promises about our software, but the local law in your country may include certain warranties. The damages you can recover for legal claims are limited.

IF YOU LIVE IN THE EUROPEAN ECONOMIC AREA (EEA), UNITED KINGDOM OR SWITZERLAND, THE GamestBase SERVICES WILL BE PROVIDED WITH REASONABLE CARE AND SKILL AND NO OTHER PROMISES OR WARRANTIES ABOUT THE GamestBase SERVICES ARE MADE. IF YOU LIVE OUTSIDE THE EEA, UNITED KINGDOM AND SWITZERLAND, GamestBase SERVICES ARE LICENSED AND PROVIDED "AS IS." YOU USE THEM AT YOUR OWN RISK. TO THE FULL EXTENT PERMITTED UNDER APPLICABLE LAW, GamestBase GIVES NO EXPRESS, IMPLIED OR STATUTORY WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT OF THIRD-PARTY RIGHTS, AND WARRANTIES ARISING FROM A COURSE OF DEALING, USAGE OR PRACTICE. GamestBase DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE PRODUCT OR GamestBase SERVICE; THAT THE GamestBase SERVICE WILL MEET YOUR REQUIREMENTS; THAT OPERATION OF THE GamestBase SERVICE WILL BE UNINTERRUPTED OR FREE FROM ERRORS, BUGS, CORRUPTION, LOSS, INTERFERENCE, HACKING OR VIRUSES, OR THAT GamestBase SERVICES WILL INTEROPERATE OR BE COMPATIBLE WITH ANY OTHER SOFTWARE. GamestBase DOES NOT WARRANT OR GUARANTEE ANY THIRD-PARTY PRODUCT OR SERVICE OFFERED VIA THE GamestBase APP STORE. IF YOU LIVE IN THE EEA, UNITED KINGDOM OR SWITZERLAND, GamestBase AND ITS EMPLOYEES, LICENSORS AND BUSINESS PARTNERS WILL NOT BE LIABLE TO YOU FOR ANY LOSSES OR DAMAGES ARISING FROM YOUR ACTIONS OR BREACH OF THIS AGREEMENT, OR WHICH ARISE AS A RESULT OF A THIRD PARTY'S (OR ANY OTHER) ACTS OR OMISSIONS BEYOND OUR CONTROL. IF YOU LIVE OUTSIDE THE EEA, UNITED KINGDOM AND SWITZERLAND, TO THE FULL EXTENT PERMITTED BY APPLICABLE LAW, GamestBase AND ITS EMPLOYEES, LICENSORS AND BUSINESS PARTNERS SHALL NOT BE LIABLE TO YOU FOR ANY LOSSES THAT WERE NOT CAUSED BY GamestBase'S BREACH OF THIS AGREEMENT, OR INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES. THE TYPES OF EXCLUDED DAMAGES INCLUDE, FOR EXAMPLE, FINANCIAL LOSS (SUCH AS LOSS INCOME OR PROFITS), COST OF SUBSTITUTE GOODS OR SERVICES, BUSINESS INTERRUPTION OR STOPPAGE, LOSS OF DATA, LOSS OF GOODWILL, AND COMPUTER FAILURE OR MALFUNCTION. THIS LIMITATION APPLIES TO ANY CLAIM ARISING OUT OF OR RELATED TO THIS LICENSE OR GamestBase SERVICE, WHETHER BASED IN CONTRACT, TORT, STATUTE, STRICT LIABILITY OR OTHERWISE. IT ALSO APPLIES EVEN IF GamestBase KNEW OR SHOULD HAVE KNOWN ABOUT THE POSSIBILITY OF SUCH DAMAGE. YOU MAY RECOVER ONLY DIRECT DAMAGES IN ANY AMOUNT NO GREATER THAN WHAT YOU ACTUALLY PAID FOR THE APPLICABLE GamestBase SERVICE. GamestBase DOES NOT LIMIT ITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, WILFUL MISCONDUCT, OR FOR DGamestBaseTH OR PERSONAL INJURY. SOME JURISDICTIONS DO NOT ALLOW THE ABOVE EXCLUSIONS AND LIMITATIONS, SO SOME OR ALL OF THEM MAY NOT APPLY TO YOU.

General Terms

A. Entire Agreement

ⓘ This agreement can be changed only in writing signed by GamestBase.

This Agreement, together with any other GamestBase terms that govern your use of GamestBase Services, constitutes the entire agreement between you and GamestBase. The Agreement may not be amended or modified unless made in writing and signed by GamestBase. The failure of GamestBase to exercise any right under this Agreement shall not constitute a waiver of the right or any other right. If any part of this Agreement is held to be unenforceable, all other parts of this Agreement shall continue in full force and effect.

ⓘ You must follow all export laws, and you agree you are not a prohibited person under export laws.

You agree to follow U.S. and other export control laws and agree not to transfer an GamestBase Service to a foreign national, or national destination, that is prohibited by such laws. You also acknowledge you are not a person with whom GamestBase is prohibited from doing business under these export control laws.

Changes to this Agreement

ⓘ This agreement can be updated by GamestBase at any time. If you do not agree to certain meaningful changes, you may not be able to play our games.

GamestBase may modify this Agreement from time to time, so please review it frequently. For GamestBase players who accepted a previous version of this Agreement, the revisions will become effective 30 days after post. Your continued use of GamestBase Services means you accept the changes. Once you accept a version of the Agreement, we will not enforce future material changes without your express agreement to them. If you are asked to accept material changes to this Agreement and you decline to do so, you may not be able to continue to use the GamestBase Service provided.

Dispute Resolutions by Binding Arbitration

ⓘ This section only applies if you live outside of Quebec, Russia, Switzerland, Brazil, Mexico, the member states of the EEA, United Kingdom and the Republic of Korea.

If you have a dispute, you agree to send details in writing to GamestBase, and then arbitrate. You agree that any claim you bring against GamestBase is in your individual capacity, and not as a class member, class representative, or as part of a class action.

THIS SECTION APPLIES TO ALL CONSUMERS AND PEOPLE WHO ACCEPTED THE TERMS OF THIS AGREEMENT. IT EXCLUDES RESIDENTS OF QUEBEC, RUSSIA, SWITZERLAND, BRAZIL, MEXICO, THE MEMBER STATES OF THE EEA, UNITED KINGDOM AND THE REPUBLIC OF KOREA. BY ACCEPTING THE TERMS OF THIS AGREEMENT, YOU AND GamestBase EXPRESSLY WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

A. Claims Covered by Arbitration

All disputes, claims or controversies arising out of or relating to this Agreement, any GamestBase Service and its marketing, or the relationship between you and GamestBase, including the validity, enforceability, and scope of this Section ("Disputes"), shall be determined exclusively by binding arbitration. This includes claims that accrued before you entered into this Agreement. The only Disputes not covered are claims (i) regarding the infringement, protection or validity of your, GamestBase's or GamestBase's licensors' trade secrets, copyright, trademark or patent rights; (ii) if you reside in Australia, to enforce a statutory consumer right under Australian consumer law; and (iii) brought in small claims court.

B. Informal Negotiations

You and GamestBase shall first attempt to resolve any Dispute informally for at least 30 days before initiating arbitration. The informal negotiations begin upon receipt of written notice from one party to the other ("Notice of Dispute"). The Notice of Dispute must: (a) include the full name and contact information of the complaining party; (b) describe the nature and basis of the claim or dispute; and (c) set forth the specific relief sought. GamestBase will send its Notice of Dispute to your billing or email address.

GamestBase actively protects the safety of users' accounts, virtual goods and virtual currency, and to this end, GamestBase will launch a severe crackdown on number theft and number theft related acts. If GamestBase finds or suspects the existence of number theft and number theft related acts including but not limited to the following, it has the right to deal with them in accordance with the provisions of paragraph 6.13, paragraph 6.14, Article 14 and other relevant clauses of this Agreement as appropriate. At the same time, GamestBase reserves the right to further pursue: (1) theft of accounts; (2) theft of virtual items; (3) theft of virtual currency; (4) theft of accounts or/and passwords; (5) transfer of items under abnormal IPs; (6) other number theft and number theft related acts. In order to maintain the fairness and order of the game, even if the user does not actively participate in number theft, but the user's items come from number theft or number theft related acts, GamestBase has the right to recall and freeze the items and accounts involved in number theft at its own discretion. Users should cooperate with GamestBase in the investigation of number theft and number theft related acts. Users should consciously maintain the order of the game, and GamestBase has the right to deal with false complaints of number theft in accordance with the provisions of paragraph 6.13, paragraph 6.14, Article 14 and other relevant clauses of this Agreement, as appropriate, if it finds or suspects the existence of false complaints of number theft.

•If a user commits a violation of the user code of conduct described in this article, GamestBase has the right to impose one or more of the following penalties on the user, depending on the severity of the behavior, and the user shall bear the adverse consequences of such:

• Warnings: Warnings are educational orientations made for minor violations of game policies and are used as a way to properly manage the operation of the game.

•Message ban: Closes some or all of the offending user's chat channels and forcibly suspends the offending user character's online conversation function, making it impossible for that character to talk to other users until this penalty expires or is lifted.

• Forced offline: force the offending user to leave the current game and end the execution of the user's current game program

• Account suspension: Suspend or permanently terminate the offending user's right to log in to a particular game using their GamestBase account.

• Temporary quarantine: transfer the offending user's game character to a special game scene and restrict its partial game operation until this punishment expires or is cancelled.

• Delete Profile: Deletes the profile of the offending user in a game world, preventing the character from appearing in the game world again.

• Delete account: Permanently terminate the offending user's right to login to the GamestBase platform through the GamestBase account, including but not limited to the user's registration information, character information, level items, game currency and other game data in the database will be permanently blocked.

• Recovery of game virtual goods: The game virtual goods, including but not limited to game virtual currency and virtual goods, acquired by the offending user due to fraud or other violations, are recovered.

• Modify name: Force to modify the name of the offending user's forum nickname, game character or gang, etc.

• Disband organizations: Disband organizations such as gangs and guilds established by the offending user.

• Backward deduction of values: Deductions are made for game character game values, including but not limited to game character level, money, experience, etc.

• Banned IP: Temporarily or permanently prohibit the offending user from logging into a certain server of a certain game at a certain abnormal IP.

• Revoke the transaction: Revoke the illegal transaction made by the user through the authorized or designated trading platform/website of GamestBase, and restore the game virtual goods paid by both sides of the transaction.

• Transaction restriction: temporarily freeze the game virtual goods or game account involved in the illegal transactions conducted by the user in the authorized/designated trading platform of GamestBase, and continuously examine the user's in-game behavior within the specified period. If the user does not violate the rules again within the specified period, the corresponding game virtual goods or game account will be automatically unfrozen upon expiration; if the user violates the rules again within the specified period, or if GamestBase determines that the violation exists, GamestBase has the right to deduct the user's game account and/or game virtual goods.

• Assume legal responsibility: If the offending user's misconduct causes damage to others or to GamestBase, or is contrary to the provisions of existing laws, the offending user shall assume the corresponding civil, administrative and/or criminal responsibility in accordance with the law, for example, if the user violates the intellectual property rights or other rights of a third party in the course of playing the game and results in a claim by the right holder, the user shall be directly responsible.

• If a user commits a violation of the user code of conduct described in this article, GamestBase also has the right to require the offending user to assume liability to GamestBase for breach of contract, including but not limited to restoration of the status quo ante, elimination of the impact, compensation for direct and indirect losses or additional costs and expenses caused to GamestBase, and recovery by GamestBase from the offending user after GamestBase has first assumed liability for administrative penalties or tort damages resulting from the offending user's conduct.

•Users can only trade game virtual goods or game accounts within the game or through the trading platform authorized/designated by GamestBase (if any, GamestBase will notify through the official website announcement, in-game announcement, cell phone SMS or other ways that can be clearly notified to users). For users to conduct other transactions on any platform not approved by GamestBase in advance (including but not limited to the user through the third party for recharge or in-game virtual goods purchase, game account trading, etc.), GamestBase will be severely combat and punishment. GamestBase has the right to take one or more processing measures according to this agreement depending on the specific situation, and if the circumstances are serious, GamestBase reserves the right to pursue legal responsibility of the user.

Game Management

• Game information transfer. GamestBase has the right to arrange splitting or merging of game servers according to the status of product and service provision. The user knows and agrees that GamestBase has the right to transfer the user's character information and character files in the game to other game servers according to its own operation arrangement. Such transfer does not affect the user's continued use of GamestBase' game services, and therefore does not constitute a breach of contract.

Fee rate policy

• The user has the right to decide independently whether to pay the corresponding fees according to the charging items (including but not limited to the right to use the virtual props in the game and other value-added services) and the charging standards determined by GamestBase itself, in order to obtain the corresponding game services. User will not be able to obtain the corresponding game services without pay the corresponding fees according to the corresponding standards.

• The user knows and agrees that the change or adjustment of charge items or charge standards is a normal business practice, and the user shall not ask GamestBase to compensate or compensate for the change or adjustment of charge items or charge standards.

• The user knows and agrees that if the user uses legal tender to recharge the game to purchase or exchange game virtual props and other value-added services, the purchased or exchanged game virtual props and other value-added services will not be refunded or exchanged to legal tender, unless otherwise mandatorily provided by law.

• User knows and agrees that: GamestBase has the right to establish, add, modify value-added services and issue tokens (tokens refer to "in-game treasure, diamonds, or platform coins") in game.Tokens are obtained through the exchange of legal tender. Once legal tender is exchanged for tokens, the legal tender is considered to have been used, and tokens cannot be exchanged for legal tender; tokens are used to purchase the right to use relevant virtual props.Users may not request GamestBase to refund any fees paid to GamestBase ("Refund"), regardless of whether such fees have been consumed. No refunds or realizations will be made for recharge amounts, virtual currency, virtual props, etc. given by GamestBase in the course of providing products and services.

User knows and agrees that:GamestBase strictly prohibits third party recharging: users may only recharge in game or through GamestBase approved trading platform (if any). GamestBase strictly prohibits the use of loopholes, including but not limited to, Apple Pay, Google Pay, and credit card payments for refunds after topping up.

Virtual Items

•All kinds of virtual goods provided by GamestBase (including but not limited to game platforms, games, forums), not limited to gold, silver, props, equipment, etc., the ownership of which belongs to GamestBase or its partners. Users can only have the right to use the virtual goods in accordance with the law and game rules. Users can only use them in accordance with the rules and regulations of the GamestBase, and may be allowed to use some of the virtual items through game behavior and recharge behavior. Once the user has purchased the right to use virtual props and tokens, he/she will be considered to have entered into the consumption process and may not request the return of the virtual props or refund for any reason.

• If the services provided by GamestBase or the various virtual goods in the game have no special requirements on the usage period, the default user can continue to use them after obtaining the usage right until the termination of the corresponding services or games provided by GamestBase; if there are special requirement on the usage period, the usage period shall be subject to the period of special requirement (but no later than the termination of the corresponding services or games provided by GamestBase). If the usage period is exceeded, GamestBase has the right to withdraw its usage right at any time without notice to the user (the usage period will not be interrupted or suspended for any reason).

• Except for massive server disconnection, GamestBase is not responsible for any loss of characters, virtual items or money caused by local network problems, personal operation problems or other reasons not attributable to GamestBase.

• In view of the complexity of online trading, GamestBase does not support users to conduct offline trading of virtual goods and offline trading related behaviors (including but not limited to participating in offline trading, assisting offline traders in operation and transferring game virtual goods and a series of other behaviors), and does not protect any trading results generated by users conducting offline trading on their own, any problems or disputes occurring between users conducting offline trading behaviors, including but not limited to being defrauded of money or game virtual goods by false trading information, are not related to GamestBase, and users will be responsible for themselves, and GamestBase is not responsible for compensation or recovery of losses caused by fraud.

• GamestBase does not support offline transactions and does not recognize the transaction results generated by users' offline transactions; the game virtual goods obtained by users through offline transactions on platforms/websites not designated by GamestBase or authorized by GamestBase will be deemed to be of sources not in compliance with the game rules; GamestBase has the right to take corresponding measures against the game virtual goods, game characters and GamestBase accounts involved in offline transactions and offline-transaction-related acts in accordance with the agreement in Article 6 of this Agreement.

Change of service method, content and transfer of personal data

• GamestBase will endeavor to continuously provide products and services to users, but to the maximum extent permitted by applicable law, it does not exclude the possibility that GamestBase may cease to provide any products and services, nor does it exclude the possibility of any changes to the service methods and service contents of the game services or other network services.

• In order to increase and enrich the content of the games and other network services provided by GamestBase, the games and game platform may be updated and adjusted from time to time in the operation of the games and game platform and the functions they contain. After the game and game platform is updated, all operations, contents and settings within the game and game platform will be subject to the content of the announcement in the game and game platform.

• If GamestBase ceases to provide a product or service, or changes the manner or content of a product or service, GamestBase will notify the user in advance and make every effort to find an appropriate service provider to take over from GamestBase and continue to provide the product or service.

• In the case described in paragraph 3 of this article and to the maximum extent permitted by applicable law, then GamestBase may transfer the user's personal data (including the relevant account and password information and personal data) to the party that continues to provide the service, and the user hereby agrees that GamestBase has the right to make such transfer and provide, and agrees that after GamestBase completes the transfer and provide, GamestBase will no longer have any obligation and responsibility for the user's original data. However, GamestBase does not guarantee to find an appropriate service provider or service method to continue provide products and services, nor the products and services would changed to meet the user's requirements.

•Users can apply inquire or operate the user's game account with GamestBase authorized trading platform/website, after the application of the trading platform/website, GamestBase can inquire, freeze, transfer, update, change, unblock the user's account and other operations, and feedback the relevant operation content and results to the trading platform. However, the user knows and confirms that GamestBase is not responsible for any operation behavior or any operation results generated based on the application of the trading platform.

Service interruption or termination

• If any of the following circumstances occur, GamestBase has the right to interrupt or terminate the game services and other network services under this agreement to users at any time, and GamestBase shall not be liable for any inconvenience or loss arising therefrom.

•Untrue personal data provided by the user.

•Violates the user code of conduct set forth in this agreement

• The user is clearly aware of the existence of the expiration date of the GamestBase account (the expiration date is subject to the public announcement of GamestBase), and agrees to log in to the GamestBase account from time to time to extend its expiration date, and the user is clearly aware that GamestBase has the right to cancel the GamestBase account that exceeds the expiration date and delete the information content in the account.

• After registering an account, if the user has no login record within 6 months and the account has never had any top-up record, GamestBase has the right to cancel the account and delete the information content in the account.

• For additional conditions for cancellation of accounts/characters for different products and services offered by GamestBase, please refer to the specific regulations for each product and service, or on the official websites of the relevant products and services.

•In order to ensure the normal operation of the game platform and server, GamestBase needs to regularly or irregularly shut down the game, game platform and server for maintenance, or emergency shutdown for maintenance in case of emergencies. The user understands and agrees that GamestBase shall try its best to avoid service interruption and limit the interruption time to the shortest possible time.

• To the maximum extent permitted by applicable law, GamestBase has the right to terminate or interrupt all or part of the services provided by the game server without prior notice for the continued stable operation of the game and server in one of the following cases, and GamestBase shall not be liable to the user or any third party for any inconvenience or loss arising therefrom.

• Regular inspections or construction, updating hardware and software, etc..

• The server suffered damage and is not functioning properly

• Sudden software and hardware equipment and electronic communication equipment failure

• Network provider line or other failures

• In case of emergency, in accordance with the provisions of the law or for the personal safety of the user and third parties

• Third party causes or other force majeure circumstances.

•To the maximum extent permitted by applicable law, regardless of the termination of products and services for any reason, after GamestBase publishes the termination of operation announcement, users shall take corresponding to dispose game and the virtual goods on the game platform by themselves within the announcement period. After the termination of the products and services, the user shall not require GamestBase to assume any form of compensation or liability for compensation other than the game virtual currency that the user has purchased but not yet used, including but not limited to compensation for no longer being able to use the game account, in-game virtual goods, etc.

Limited Warranty and Disclaimers

• For all products and services, GamestBase makes limited warranties described in this section, and such limited warranties supersede any other warranties, express or implied, in any documents, packaging or other materials, if any.

• GamestBase provides the relevant products, software or programs and any support services on an "AS IS, WITH ALL FAULTS" basis and warrants only that.

•The products and services offered by GamestBase can substantially meet the requirements officially announced by GamestBase.

•The relevant products and services provided by GamestBase are basically in line with the service commitments officially announced by GamestBase.

• GamestBase will only endeavor to resolve any problems encountered by GamestBase in the course of providing its products and services to the extent reasonably permitted by law.

• To the fullest extent permissible pursuant to applicable law, GamestBase expressly disclaims all other warranties of any kind, whether express or implied, including, but not limited to, any implied warranties and liabilities of merchantability, fitness for a particular purpose, reliability, accuracy, completeness, and freedom from error.

• To the fullest extent permitted by applicable law, GamestBase does not warrant that the products and services provided by GamestBase will meet the user's requirements, that the products and services provided will be uninterrupted, or that the products and services will be timely, secure, and uninterrupted, or that no errors will occur, or that the information will be delivered accurately, timely, and smoothly.

• The user understands and agrees that it is entirely up to the user to trust and use any information and materials obtained through GamestBase' products and services, and that the user assumes the risk of system damage, loss of data, and any other risks arising from such trust and use. GamestBase does not guarantee any information sent by any third party mentioned in the products and services (including but not limited to any product shopping services, transaction process, job information, etc.).

• In case of system failure, security vulnerability (Security Vulnerability), program defect (Bug), program error, etc., GamestBase has the right to restore the game's data to a certain date in order to maintain the balance of the game. Users shall not demand compensation or damages for this reason.

• To the maximum extent permitted by applicable law, GamestBase shall not be liable to users for any indirect, incidental, special or consequential damages (including, without limitation, damages for personal injury, breach of privacy, failure to exercise any duty of care, including good faith or reasonable care, negligence and any other pecuniary loss or other loss) arising out of the use of GamestBase' products and services. These damages may result from improper use of the products and services by the user or others, purchase of goods or similar services online, transactions on the Internet not designated or authorized by GamestBase, illegal use of the services, or changes in information transmitted by the user.

• GamestBase shall not be responsible for any service interruptions, loss of data or short messages sent by users, garbled codes, wrong reception, inability to receive, delayed reception, etc. caused by the failure of fixed and mobile communication networks of domestic and foreign basic telecommunication operators, various technical defects, coverage restrictions, force majeure, computer viruses, hacker attacks, user location, user shutdown, partner factors, other people's intentional or negligent behavior or other reasons not within the technical capacity of GamestBase involved under this agreement.

• The user is responsible for any consequences caused by personal mistakes, errors, improper operation, failure to authenticate with real name, etc. GamestBase will not provide any compensation or indemnity.

• Users in the non-GamestBase prior approval of the third-party trading platform for transactions, the resulting transaction behavior, transaction results or any disputes with the trading platform, legal liability or the user's personal account and virtual property risks are not related to GamestBase.

Intellectual Property and Information Ownership

• The game software (including games with client software and games without client software), other software, information, works and materials provided by GamestBase to users through products and services, and their copyrights, patents, exclusive rights of trademarks and other intellectual property rights are owned by GamestBase or their corresponding right holders. Unless legally authorized by GamestBase in writing in advance, no one shall use, copy, disseminate, forge, imitate, modify, adapt, translate, compile, publish, reverse engineer such as decompiling or disassembling without permission in any form, otherwise GamestBase shall have the right to immediately terminate the products and services provided to the user and pursue its responsibility for intellectual property infringement according to law and require the user to compensate GamestBase for all losses.

• Any data information (including but not limited to account data information, character data information, level item data information, etc., except the user's name, ID number, telephone number and other personal identity data information) generated by the user in the process of using the products and services and stored in the servers of GamestBase belongs to the game or part of the game platform, which is owned and managed by GamestBase, and the user has the right to modify, transfer and dispose of the data information belonging to his account through the channels specified by GamestBase under the premise of complying with the rules of the game.

• In order to ensure accuracy and avoid disputes, the user agrees to use the data and information about technical aspects involved in this agreement as the standard of judgment by the data stored in the servers of GamestBase, and GamestBase guarantees the authenticity of such data.

Damage Compensation

• If the user violates this Agreement or applicable laws and regulations, and causes GamestBase, its subsidiaries, other affiliates, subsidiaries and their personnel, employees, agents and all other relevant performance support personnel to suffer damages or incur any derivative costs (including but not limited to paying all legal costs of the above-mentioned legal subjects to defend or claim litigation and related settlement for the user's breach or violation of the law), the user shall be liable for reimbursement of related costs and payment of damages.

Termination of Agreement

Users shall comply with the provisions of this Agreement. GamestBase has the right to determine whether the user has violated this Agreement. If GamestBase determines that the user has violated this Agreement or any laws and regulations, GamestBase shall immediately suspend or terminate the user's account and delete all relevant information, files and any records in the user's account without prior notice to the user, as well as restrict, stop or cancel the user's eligibility to use.

Modification and interpretation rights

• To provide products and services to users in a timely and better manner, based on the consideration of GamestBase itself, users and changing market conditions, GamestBase reserves the right to modify, add or delete the terms and conditions of this Agreement at any time within the maximum applicable scope of the law. When modifying, adding or deleting the terms and conditions of this Agreement, GamestBase will announce the fact of modification, addition or deletion on the official website without individual notification to the user. If the user does not agree with the content modified, added or deleted by GamestBase, he/she may immediately stop using the services provided by GamestBase. If the user continues to use the services provided by GamestBase, it is deemed that the user agrees and accepts the modified, added and deleted contents of this agreement, and shall not demand any compensation or indemnity for this reason.

• Users may not transfer their rights or obligations under this Agreement without the prior written consent of GamestBase. GamestBase shall have the right to exercise its rights or perform its obligations under this Agreement through GamestBase' subsidiaries or other affiliated companies.

Advertisements and External Links

• GamestBase' products and services may contain advertisements for other people's commercials or other event promotions. These contents are provided by the advertisers or providers of goods/services and bear the corresponding responsibility, and GamestBase only provides the medium for posting the contents. The transaction behavior of such services or goods purchased by users through GamestBase or websites linked to GamestBase exists only between users and the providers of such goods or services, and has nothing to do with GamestBase, and GamestBase is not liable for the transaction behavior arising between users and the providers of such goods or services.

• Users may link to third party sites in the course of using GamestBase' products and services. The third party sites are not under the control of GamestBase, and GamestBase is not responsible for the content of any third party sites, any links contained in third party sites, or any changes or updates to third party sites. GamestBase provides these links to third-party sites to users only as a convenience, and the fact that GamestBase provides these links does not mean that GamestBase endorses the third-party site or that GamestBase guarantees its authenticity, completeness, timeliness, or trustworthiness. There is also no employment, appointment, agency, partnership or other similar relationship between these individuals, companies or organizations and GamestBase. Users are required to check and comply with the rules of such third party sites.

• The user understands and agrees that GamestBase sends products and services or other related commercial information to the user by email, SMS or other means.
